Chinese Patent Matter Workflow: Intake, Review and Filing Handover

Updated · 3 min read· Patent Task Editorial Team

A Chinese patent matter should have identifiable technical sources, versions, approvals and next-action owners. The following is a suggested team workflow, not a claim that every firm uses the same timetable or review rounds.

Define the matter at intake

Confirm the applicant, inventors, scope of engagement, where the invention was completed, disclosures already made or planned, and target countries. Product releases, papers, exhibitions and customer deliveries should be assessed by the responsible practitioner. Do not assume a universal grace period.

Chinese Patent Law Article 18 distinguishes representation requirements for different applicants. Article 19 addresses confidentiality examination before foreign filing of inventions or utility models completed in China. Neither “every Chinese filing requires an agent” nor nationality alone is an adequate rule.

Assign a deliverable to each stage

Preserve meaning through client edits

If a client says a pad is optional, determine whether that changes the mechanism, effect or intended scope. Do not delete it from the description while leaving an unexplained mandatory limitation in the claims. Post-filing amendments require separate review of the original disclosure under Article 33.

Separate drafting files from filing formalities

Article 26 addresses invention and utility-model application documents; Article 27 addresses designs. Additional material depends on the application type, priority and other circumstances. One checklist does not describe every complete application.

Before submission, check names, identities, priority, files and fees. Afterward retain the actual receipt. Downloading a Word file is not submission to CNIPA; an application number is not a grant.

Use AI as part of the handover

This article is a reference for Chinese matters. Patent Task currently offers new drafts for US, EP and JP filings, not CN filings. Its disclosure preparation tools can help organize invention facts for a supported target; Chinese claim review and filing remain separate professional tasks.

Use the disclosure template, Chinese drafting requirements and Word review guide together.
