Chinese Patent Drafting Requirements: Disclosure, Claims and Amendment Basis
A Chinese invention or utility-model application raises separate questions: does the solution meet the conditions for patent protection, does the description explain it sufficiently, and do the claims have support? A tidy format answers none of these on its own.
Review separate requirements
| Requirement | Primary reference | Drafting question |
|---|---|---|
| Novelty, inventive step and practical applicability | Patent Law Article 22 | What is the relevant prior art and what differs? |
| Disclosure and claim support | Article 26 | Is the solution sufficiently explained and are the claims based on the description? |
| Amendment scope | Article 33 | Where is the proposed change supported in the original application? |
See the Chinese Patent Law published by CNIPA. This article organizes work around these provisions; it is not a complete account of every examination rule or subsequent amendment.
Write from technical facts
Explain how components or steps work together, which problem they address and what supports the stated effects. Distinguish verified public references from the inventor's experience. Do not invent experiments or citations to strengthen the narrative.
A conventional section structure can help organize the description, but completeness of headings is not sufficiency of disclosure. The claimed subject matter may require details about experiments, processing steps, connections or operating conditions.
Build a support record
For each key feature, record the disclosure passage and description location. For a numerical range, record units, measurement method and factual basis. For functional wording, identify the implementation. For an alternative, identify where the original material actually describes it.
A location in a table is not automatic proof of legal support. Scope must still be assessed against the document as a whole and the applicable examination framework.
Separate drafting from post-filing amendment
Before filing, missing facts can be requested from the inventor and confirmed. After filing, proposed changes must be assessed against the original application. Later research is not a substitute for original disclosure. Keep the original wording, proposed wording, basis and reason for each change.
Does correct numbering or a two-part format establish compliance?
No. Check applicable formal requirements alongside technical content, claim scope and dependencies. A software completion indicator or quality score is not a legal threshold.
These Chinese requirements are provided for research and professional reference. Patent Task currently supports new US, EP and JP drafts; it does not create new CN applications. Use the disclosure preparation tools for a supported target and handle Chinese document preparation and filing separately. See the workflow guide and Chinese matter handover checklist.
