How to Write a Patent with AI: From Disclosure to a Reviewable Draft
An AI-assisted drafting workflow can be organized into disclosure preparation, direction setting, generation, review and export. The target is a working draft with traceable technical facts, not an assumed filing-ready or granted patent.
This guide uses Patent Task's disclosure-to-draft workflow for US, European and Japanese applications. Each jurisdiction has its own document structure and output boundaries, including the Japanese workflow. It is a product guide, not an independent benchmark or a promise of fixed time savings.
Choose the next step for your material
| What you have now | Work to do next | Useful starting point |
|---|---|---|
| An idea and scattered engineering notes | Explain the mechanism and identify missing facts | Blank invention disclosure template |
| A complete technical explanation | Decide which features and relationships the draft should describe | Annotated patent claims example |
| A draft and a set of figures | Compare parts, labels and references across documents | Drawing reference-number checklist |
| Reviewed text ready for handover | Save, export and open the actual document | Export checks below |
If you already have a disclosure, open the drafting preparation page to create and review a plan from it. Before starting the draft, check the selected jurisdiction and supported application type: writing in English does not by itself make a draft suitable for a US application.
1. Prepare the disclosure
Explain the technical field, specific problem, structures or steps, interactions and evidence of effects. Keep unknown parameters, unverified effects and inventor questions separate. Use the disclosure template and synthetic example.
Open drafting preparation. Enter an idea or paste an existing disclosure, or upload a PDF with selectable text, Word (.docx), TXT or Markdown document. Choose Create drafting plan. You can prepare and edit the plan before signing in; a scanned or unreadable file needs usable source material rather than guessed content.
For cited documents, retain an identifier and relevant passage and verify the original through patent search. Do not treat a reference generated by AI as a verified document. Initial trials can use synthetic or authorized de-identified material.
2. Review the technical solution and drafting plan
Check the plan's technical understanding, protection focus, document outline, drawing arrangements and missing information against your material. For a short idea, the plan can propose a concrete technical solution; distinguish those proposals from facts supplied by the inventor and from measured results. Edit the plan to retain the solution you intend to adopt and correct unsupported assumptions.
Review the suggested title, technical field and classification as part of that plan. Correct the editable plan where needed; you do not need to complete a separate title-refinement stage before preparing the solution. An optional planning diagram helps explain the proposal but is not a formal application drawing.
3. Check the jurisdiction and type, then confirm and start drafting
Choose Confirm plan and start drafting, then review the filing jurisdiction before starting the draft. Patent Task offers US, EP and JP invention drafting; it does not offer new CN, KR, PCT or utility-model drafts. The initial jurisdiction follows the interface language, so check that the selected target matches your intended filing. Translation alone does not adapt a draft to another jurisdiction's substantive requirements.
If you are not signed in, the continuation prompt preserves the current plan while you sign in. The workflow saves the confirmed plan and uses it with your source material to start the draft in the selected jurisdiction. You do not need to re-enter the disclosure into a separate set of field, problem and description inputs, or expand a short idea to satisfy an arbitrary minimum character count.
Review the completed claims, description, abstract and figures as they become available. New projects use the full-draft workflow; section-based drafting remains available for existing drafts. The confirmed plan is the shared basis for the content, so check any proposed design choices and research limitations along with the prose.
| Output | First review |
|---|---|
| Claims | Subject matter, features, references and disclosure basis |
| Description | Implementation and support for the claimed features |
| Drawings | Components, connections, numbers and text references |
| Abstract | Accurate summary without new unsupported material |
| Quality prompts | The concrete passage behind each issue |
4. Review the facts before polishing language
Locate the source for each important feature. Check dependent-claim relationships, implementation details, terms, signs and numerical data. Ask the inventor about unexplained structures or results. Assess prior art and scope using verified sources and the applicable framework.
A quality score cannot replace this work. If the disclosure contains no clamping-force measurement and the draft supplies one, investigate and correct it rather than accepting a fluent sentence.
Example: turn a vague sentence into a technical explanation
“The clamp holds the part better” names an intended result, but does not explain the means. In our synthetic example, “a screw advances a movable jaw along a guide slot toward a fixed jaw; opposing V-shaped grooves locate a cylindrical workpiece” supplies structures and their interaction. It still leaves questions about dimensions, materials and operating limits.
Use those questions to revise the disclosure and review proposed design choices in the plan. Keep an adopted proposal distinct from a tested result. The claim-by-claim example shows how to trace a proposed feature back to its supporting material. The example is invented for instruction and is not evidence of patentability or measured performance.
5. Check access and open the export
Word export is available under the applicable entitlements or project-unlock conditions. Preview, complete access, editing and export can have different restrictions. Check the current pricing page and actual purchase information.
After saving, download and open the file. Confirm sections, claim numbering, editable text, images, symbols, pagination and agreement with the approved draft. Keep evidence of any problem and contact support. Refund conditions are described in the refund policy.
Before submission
- Confirm technical facts with the appropriate people.
- Trace claims to the disclosure and description.
- Verify figures, references and data.
- Open the actual exported file and check applicant/inventor information separately.
- Complete the appropriate professional and procedural review for the target filing.
Patent Task is an independent third-party tool, not affiliated with any patent office. Export is not official submission and does not guarantee acceptance or grant. Compare tools with the evaluation checklist.
Common questions about AI patent writing
Can AI write the entire application from a short idea?
A short idea can be used to prepare a proposed technical solution and drafting plan. Review the structures, steps and assumptions before adopting that plan. Proposed design details are not evidence that an implementation has been built or tested; missing experiments, performance data and other observations must not be invented. A longer draft is not necessarily a better-supported draft.
Should I search before drafting?
Search can help you understand terminology and compare known approaches. Keep the original documents and relevant passages using a search log. A quick search does not establish novelty or freedom to operate.
Where should I start in Patent Task?
Start with the preparation page, or open the drafting preparation page and check the jurisdiction before starting the draft. Prepare your material, review the plan, check the application type and jurisdiction, then confirm and continue. If your immediate task is explaining a structure visually, begin with the patent drawing workspace and examples. Check current access and pricing before planning an export.
