How to Evaluate AI Patent Drafting Software for US Workflows
Evaluate AI patent drafting software by taking a disclosure through a correction, a saved revision and an editable Word handoff. A convincing first paragraph does not show whether a patent attorney or agent can control the resulting draft, trace its factual support or reuse the exported file.
For a US workflow, define the intended deliverable before comparing products: an organized disclosure, a claim outline, a connected specification and claims draft, or a document ready for further professional editing. Those are different tasks. A tool that is useful for one may leave substantial manual work in another.
This is a reproducible evaluation method published by Patent Task. It is not an independent ranking, a competitor benchmark or a report of measured model quality. The exercises below are proposed tests, not claims that our product or another product has passed them.
Define the work your team needs to hand off
Write down a required outcome and the evidence that would establish it. Include the actual editor and reviewer in the trial where possible.
| Workflow need | Evidence to request or produce |
|---|---|
| Technical disclosure intake | A source version with confirmed facts, missing details and proposed additions distinguished |
| US drafting structure | A sample with recognizable description, claims and abstract, consistent with the selected jurisdiction |
| Claim support review | Specific limitations mapped to source passages and description locations |
| Controlled revision | A requested change applied without silently altering unrelated technical facts |
| Saved work | The expected revision remains after leaving and reopening the project |
| Word handoff | An actual DOCX that can be opened, edited, saved and reopened in your editor |
| Team suitability | Clear account, review and client-delivery terms for the way you intend to work |
| Data handling | Written answers about processors, retention, training use, deletion and access |
The USPTO utility application guide provides the document context. A vendor's “USPTO-ready” label should not replace inspection of what is actually generated and exported. The US drafting guide gives a document-review checklist for the trial.
Distinguish drafting help from a legal conclusion
A tool may produce grammatical claims while missing the disclosed relationship that makes the invention work. It may also create a supporting paragraph from the same unsupported assumption. Those two passages are not independent evidence of support.
35 U.S.C. § 112 supplies the US statutory context for description, enablement and claims. In the trial, ask for traceable source locations and review them. A quality score or an automatic “compliant” label does not establish that the legal requirements are satisfied.
You can practice the reading method with the separate positioning-clamp claims example. The desk-edge clamp below is a different synthetic fixture, retained so the same input can be reused across candidates.
Use one controlled disclosure across candidates
Use the same input, jurisdiction and requested deliverable. Record any preprocessing, prompts or manual instructions needed by each service; a chat tool and a dedicated workspace may accept different material.
Exercise A — synthetic desk-edge clamp
Jurisdiction for this exercise: United States.
Requested output: an editable utility patent draft for professional review.
Purpose: hold a lightweight workpiece against a desk edge.
Body 10 has a guide channel. Sliding jaw 20 moves along the channel.
Screw 30 is supported by body 10 and moves jaw 20 toward the workpiece
when the user turns knob 40. Pad 50 contacts the workpiece.
The disclosed relationship is guided jaw movement driven by the screw.
There is no sensor, motor, wireless connection or automatic controller.
The pad material is not yet selected. No force or durability test results
are available. Keep those facts unresolved; do not invent specifications.
Organize these facts, identify missing implementation information,
and prepare a figure plan and draft sections supported by this input.
Distinguish any proposed additions from the supplied facts.
The fixture is deliberately incomplete. A useful result identifies missing information rather than hiding it behind confident language. Do not reward a tool for fabricating a precise material, load rating or experiment.
For your later authorized work, use the invention disclosure template to build a source record with real locations and a confirmed version.
Run the whole drafting and revision exercise
1. Inspect intake and the first draft
Check whether the tool preserved the explicit unknown pad material and absent test results. Look for added electronics, changed movement, removed components and invented references. Record the exact passage, source fact and correction needed.
Inspect the proposed figure plan separately. It should explain disclosed relationships; a plan does not establish that a completed figure is correct or that all needed implementation facts exist.
2. Trace the claims through the description
Choose the guided-jaw movement and screw drive as two features to follow. Locate each in the source, claims and description. Record unresolved engagement details. Check that body 10, jaw 20, screw 30, knob 40 and pad 50 keep their identities throughout.
A tool may expose only part of a draft during a trial. Mark hidden support as untested, not correct. An unsupported feature remains a finding even if the surrounding language is polished.
3. Make a controlled technical correction
For exercise revision B, explicitly supply this new synthetic fact:
Pad 50 is removable and retained in a recess in sliding jaw 20. Its material remains unspecified, and there are still no force or durability test results.
Record that revision B comes from the evaluator; it is not something the tool should have inferred from revision A. Use the product's supported editing or regeneration controls. Then check the affected claims, pad description, figure plan and abstract for obsolete wording. Confirm that unrelated features did not change.
If you also want to assess text-only editing, rename “sliding jaw 20” consistently and inspect all references. Record whether the tool can make the requested change, whether you must edit manually, and what review work remains.
4. Save, leave and reopen
Reopen the same project and verify the saved revision. Check both the edited passage and a related passage elsewhere. If a tool has no project persistence, record the alternative handoff it offers; do not assume that a chat history is a versioned matter workspace.
Where regeneration is available, determine which content it replaces before using it. Include loss of manual changes in the evidence sheet if it occurs.
5. Inspect Word in the editor your team uses
If access includes export, download the actual DOCX. Open it in Word or your intended editor, edit a sentence, save and reopen it. Check claim numbering, paragraph structure, figure references and the readability of images. If your own material uses equations or tables, add a separate synthetic test containing those elements; this clamp fixture cannot prove those capabilities.
Test tracked changes or comments in your chosen editor if they are part of your review process. Distinguish ordinary Word editing from a vendor's claimed Word add-in or round-trip synchronization. Do not infer either integration from a downloadable DOCX.
The USPTO's DOCX guidance explains its own document processing and feedback. A successful vendor download is evidence of a file handoff, not evidence of acceptance by the USPTO.
Check data and client-delivery terms before real material
Ask for written answers, then record the document, version and unresolved points. Marketing shorthand such as “private” may not answer the questions your organization needs resolved.
| Question | What to record |
|---|---|
| Which service and model providers process the disclosure? | Named providers, processing locations where disclosed, and applicable terms |
| Is material used for training or other secondary purposes? | The precise scope, exceptions and account-specific commitments |
| How long are inputs, outputs and backups retained? | Published retention periods and deletion process |
| Who can access a matter? | Account sharing rules, staff access and any team controls actually available |
| May the output be delivered to a client? | Relevant ownership, redistribution and professional-use terms |
| Can you retrieve work when ending the service? | Available export and account-closure process |
An unanswered question is an unanswered question. It should not become an assumed security guarantee or a claim that a service is unsafe. Keep initial tests synthetic while the appropriate person reviews client authorization and your organization's requirements.
What does “free patent drafting software” include?
Free access is one part of the evaluation. Define the free task precisely: disclosure preparation, generation, correction, saving, full-text inspection or export.
| Offer | What to verify for your task |
|---|---|
| Free editor or template | Whether it only organizes your own text or also generates material; whether you can save and export |
| Limited AI allowance | Operations, limits, expiry and whether a correction consumes the allowance |
| Restricted preview | Which sections or images are visible, and what remains untested |
| Paid workflow after a trial | The exact purchase needed for the document, revisions and continuing access |
Record the offer and date. A free initial response is not the same as a free editable patent document. If a purchase blocks the export test, retain the quoted condition and mark export untested; do not infer quality from the visible preview.
For assistance from people rather than software, consult the USPTO pro se assistance resources. A software trial and professional representation have different scopes.
Keep an evidence sheet instead of a feature score
| Trial item | Record |
|---|---|
| Configuration | Date, product, plan, visible model setting if any, jurisdiction and input version |
| Factual accuracy | Exact passage, source fact and required correction |
| Claim support | Limitation, source location, description location and unresolved gap |
| Revision B | Action taken, affected passages and unexpected changes |
| Persistence | Revision observed after reopening |
| Export | Actual file inspected, editor used and editing result |
| Human effort | Corrections and measured trial time; no projected savings |
| Commercial scope | Available free operations, quoted paid scope and untested steps |
| Data and client delivery | Documents reviewed, answers received and open questions |
Choose against the required outcome. For organizing notes, a template and manual editor may be sufficient. For a connected draft, compare the accessible end-to-end workflow and remaining professional work. One fixture cannot establish performance across software, chemistry and mechanical inventions.
Try the same method in Patent Task
The US drafting workflow and example explains the current drafting entry. Provide material, review the proposed plan and confirm the US jurisdiction before continuing. Full document visibility and Word export depend on the applicable access shown in the workspace. This article does not promise unlimited free drafting or a fixed free allowance.
The separate drawing workspace has its own preview limits; it should not be treated as proof of a complete US drafting workflow. Evaluate any drawing output against its actual scope and source facts.
Check current pricing, privacy, terms and refund conditions, and use support for unresolved questions. Keep the evidence sheet and the actual trial document. Those are more useful for a purchasing decision than a feature list alone.
