Reviewing Japanese Patent Drafts: Dependencies and Amendment Records
Reviewing a Japanese draft involves two questions: is the current text internally coherent, and does each proposed change have an appropriate basis? These require different records. A formatting check cannot replace either assessment.
Map the dependencies
For each claim, record its subject matter, referenced claims and additional limitations. Expand range references, check that the numbers exist and compare the recorded relationship with the actual wording. Recheck later claims after deleting or combining a claim.
In a synthetic example, claim 3 refers to claim 2, but the revision deletes claim 2 without updating claim 3. A dependency record reveals the break; deciding how to repair it still requires substantive review.
Review meaning against the description
| Item | Record |
|---|---|
| Terms | Whether names identify the same object consistently |
| Conditions | Optionality, necessity, ranges and negation |
| Support | Relevant description and disclosure locations |
| Figures | Numbers, reference signs and actual images |
A mapped passage helps locate evidence; it does not automatically establish support or clarity. The JPO guidelines separately address support, clarity, conciseness, unity and amendment requirements.
Retain four records after a notice
Keep the actual notice, original application, proposed version and amendment explanation. State the reason and original basis for each substantive change and identify affected claims, text and drawings. Do not amend a formal draft solely because AI predicts what an examiner might want.
The responsible practitioner should assess amendments, division or acceleration against the actual procedural stage and current rules. A generic deadline table does not replace the matter's docket.
Understand the product checks
Patent Task's Japanese workflow checks items such as references and document relationships and organizes paragraph numbering at export. Internal completion conditions, title-length prompts and quality scores must not be presented as statutory JPO thresholds.
The Japanese workspace exports four substantive documents; the request form and actual filing are separate. See Japanese document preparation for the scope.
Can the English guidelines replace the Japanese original?
The official page warns of translation timing differences and gives the Japanese text precedence in ambiguity. Check the applicable version and original provision before relying on it for a decision.
