German Patent Drafting Guide: DE Claims, Description and Abstract
A German national patent draft needs a consistent technical account: the claims identify the subject matter, the description explains how to carry it out, and the drawings show the same components and relationships. This guide helps patent professionals and technical teams prepare those documents for a DE application at the German Patent and Trade Mark Office (DPMA).
DE is a separate route from a European application at the EPO. Writing in German does not, by itself, select the national route. The German drafting workspace prepares German-language invention-patent drafts; it does not prepare utility-model or design applications. This article covers technical drafting, not a complete application package or a filing service.
Official sources were checked on 24 October 2026. Requirements below cite the German Patent Act (PatG), Patent Ordinance (PatV) or DPMA guidance. Examples and working checklists are editorial recommendations.
1. Establish what the inventor actually disclosed
DPMA explains that the application must disclose the invention clearly and completely enough for a skilled person to carry it out. Completing a form is insufficient. See the DPMA application guidance.
Before drafting, collect the operating mechanism, relevant sketches, known prior art, supported alternatives and unresolved questions. Separate measured results from expected effects. Record the source version so that a later wording change can be checked against the same technical facts.
We use a fictional temperature-control example throughout this guide:
| Confirmed teaching facts | Still unresolved |
|---|---|
| Sensor 10 supplies a measured temperature T to controller 20 | Sensor position, type and signal interface |
| Controller 20 controls fan 30 | Fan drive circuit and physical arrangement |
| The fan turns on when T reaches or exceeds upper threshold H | Actual threshold values and how they are chosen |
| The fan turns off when T reaches or falls below lower threshold L; L is below H | Initial fan state and handling of a missing or invalid measurement |
| Between the thresholds, the previous fan state is retained | No test data or quantified performance improvement is supplied |
These are invented teaching facts, not a customer invention or a patentability assessment. The missing details remain questions. A drawing generator must not silently add a sensor-failure branch, and a drafting model must not turn an expected effect into a measured result.
Use an invention disclosure worksheet if the source material is not yet organized. The practical benefit is that the reviewer can distinguish a drafting correction from a new design decision.
2. Build the description around an executable account
PatV § 10 specifies the description's contents, including the invention title, relevant known prior art, the claimed invention and at least one detailed way of carrying it out. Technical field, problem, industrial applicability and advantageous effects are addressed as applicable under that provision.
An effective working structure is:
| Part | What to write | Example check |
|---|---|---|
| Title and technical field | Identify the technical subject without advertising | “Temperaturabhängige Lüftersteuerung” identifies the example |
| Background | Explain the relevant known approach and verified sources | Do not invent a patent publication or declare all existing controllers defective |
| Problem and solution | Connect the technical task with the disclosed combination | Explain the two thresholds and retained state between them |
| Figure overview | Give a short, accurate description of each real figure | A block diagram and a control flowchart answer different questions |
| Detailed implementation | Explain components, connections, conditions and sequence | Identify what happens at both boundaries and inside the interval |
| Supported variants and effects | Describe only supplied alternatives and justified effects | Leave unavailable test values and startup behavior open |
Before — an unsupported result statement:
Die intelligente Steuerung optimiert die Kühlung automatisch und senkt den Energieverbrauch um 40 Prozent.
After — a supported account of the disclosed operation:
Die Steuerung (20) empfängt den vom Temperatursensor (10) erfassten Temperaturwert T. Erreicht oder überschreitet T den oberen Schwellenwert H, schaltet die Steuerung den Lüfter (30) ein. Erreicht oder unterschreitet T den unteren Schwellenwert L, schaltet sie den Lüfter aus, wobei L kleiner als H ist. Zwischen den Schwellenwerten behält sie den bisherigen Schaltzustand bei.
The revised paragraph preserves the supplied behavior and removes the invented percentage. It does not resolve sensor placement, startup or failure handling. Those require technical clarification; polished prose is not a substitute.
3. Write claims from the disclosed combination
PatV § 9 permits one-part or two-part claims. The first claim states the essential features. Multiple independent claims are possible where unity is maintained. Do not import an EPO claim-category restriction merely because the draft is in German.
For two-part wording, identify which features are known from the relevant prior art before assigning them to the preamble. A phrase such as “dadurch gekennzeichnet” cannot establish novelty. A one-part teaching claim avoids inventing that prior-art division:
This is an annotated drafting exercise, not a recommended claim for an actual filing. The appropriate essential features and scope depend on the complete disclosure and relevant prior art. The example omits unresolved implementation details rather than pretending they are confirmed.
Create a support map for the real draft:
| Claim feature | Original disclosure | Description and drawing check |
|---|---|---|
| Sensor supplies T to the controller | Identified source paragraph or sketch | Signal direction and component names agree |
| Two thresholds, with L below H | Inventor's stated control logic | Both comparisons and their equality boundaries appear |
| Previous state retained between thresholds | Identified operating sequence | Flowchart has a retention outcome, not an invented default “off” branch |
Record real draft locations when using this table. Repeating a feature in AI-generated claims and description does not demonstrate support in the inventor's material. Amendments remain subject to the original disclosure: PatG § 38 does not permit deriving rights from an extension of the application's subject matter.
4. Prepare the German abstract using a character count
Under PatV § 13, the abstract should contain no more than 1,500 characters. This is a “should” standard, not a 150-word rule. PatG § 36 describes its technical-information purpose and contents: title, a concise account of the disclosure, and the relevant drawing where one is mentioned.
As a practical drafting method, count spaces too and leave room for the title. Summarize the technical problem, core solution and principal use after the claims and description are stable. Do not replace the title and technical explanation with a product slogan.
For the example, the central sentence could be:
Eine temperaturabhängige Lüftersteuerung verwendet einen oberen und einen unteren Schwellenwert, um einen Lüfter ein- beziehungsweise auszuschalten und dessen bisherigen Schaltzustand zwischen den Schwellenwerten beizubehalten.
That sentence is a starting point for the technical summary, not a complete abstract with every required element. Select a representative drawing that actually exists and agrees with the text. Do not invent a new composite figure just to fill an abstract-figure field.
5. Review the drawings and the exported pages
The DPMA drawing requirements guide covers sheet dimensions, labels, reference signs and a paired flowchart example. Review the actual image, not only its title or generation instructions. A claim can preserve the threshold logic while a generated figure accidentally changes it.
Text and drawing pages have different layout rules. For text, PatV § 6 specifies A4, single-column text, 1.5 line spacing and minimum margins of 25 mm left and 20 mm top, right and bottom. Characters must meet the prescribed size, including at least 10-point type. The provision also addresses separate sheets, description page numbering and avoidance of justification, decorative emphasis, line and paragraph counters.
Patent Task's DE Word export uses 12-point text as a product choice. Open the exported DOCX and inspect the actual pages, equations, German characters, claim numbering, section starts and embedded figures. An editable Word file is not a validated DPMAdirekt submission package.
6. A handoff checklist for the reviewer
- The selected jurisdiction is DE, and the intended text is German.
- The source disclosure version and unresolved technical questions are identified.
- Each claim feature has support in the actual material, not only in generated prose.
- Essential component relationships, conditions and operating states are explained.
- Prior-art references were checked and do not contain invented identifiers or passages.
- Description, claims, figures and abstract use consistent terminology and reference signs.
- Effects are identified as measured, expected or still to be established.
- The abstract has been checked in characters, with title space considered.
- The final exported pages contain the intended revision and all required actual figures.
DPMA distinguishes the preliminary review of an application from substantive examination, which requires an examination request. Draft preparation is one part of that broader process; see the official examination overview for procedural information.
Start a German draft from your own disclosure
Start a DE patent draft, review the proposed plan against your source material, and keep the unresolved questions visible while editing. If the technical account is already prepared, start a DE drawing project with the corresponding component names and figure purposes.
Patent Task assists with editable technical drafts and drawings. It does not determine patentability, submit an application or replace the professional review of the actual facts and documents.
Can I use my European patent draft unchanged for DPMA?
Use it as source material only after checking the national requirements and the intended German wording. DE and EP are distinct workflows. In particular, check the DE claim provisions, character-based abstract guidance and drawing/text sheets rather than assuming one export fits both routes.
Must every German claim use two-part form?
No. PatV § 9 permits one-part or two-part wording. Choose based on the technical case and verified prior art, rather than automatically inserting a characteristic-part phrase.
Does AI resolve missing implementation facts?
It can suggest questions or possible designs. A suggestion becomes part of the source disclosure only after appropriate technical confirmation; it is not evidence that the inventor supplied that detail.
