Patent Drafting Needs Both Technical-Field and Jurisdiction Review
Technical field determines which implementation details need explanation. Jurisdiction determines the framework for assessing and presenting the application. These are parallel review dimensions, not a single “adapted” status.
Keep separate evidence for each layer
| Layer | Question | Reviewable evidence |
|---|---|---|
| Technical facts | Is the mechanism or processing accurately explained? | Disclosure, drawings, tests and operating sequence |
| Technical expression | Do features connect clearly to their effects? | Feature-to-source record and implementation details |
| Jurisdiction | Which subject-matter, support and procedural rules apply? | Applicable rules and local review |
| Delivery | Do documents and filing requirements match? | Final files, submission list and approvals |
The table organizes work. It does not assign invented quality weights or universal scores.
A synthetic sorting-system example
The mechanical part needs conveying, positioning and actuation details. The algorithm needs inputs, processing and control outputs. If the draft connects two mechanical parts incorrectly, changing the section headings to another country's format does not repair that error.
Conversely, accurate technical content does not make literal translation sufficient. Local claim categories, amendment basis and filing procedures may need separate consideration. Give the target-jurisdiction reviewer a record of confirmed facts and identify what must be retained, rewritten or clarified.
Explain each revision
Keep the original sentence, target wording, type of change, technical basis, jurisdictional basis and approver. Distinguish translation corrections, new disclosure, claim-scope changes and formatting. Otherwise a language edit can silently become a substantive amendment.
Chinese Patent Law Articles 26 and 33 illustrate the distinction between disclosure, support and amendment basis. For international planning, the WIPO PCT FAQ explains that national or regional offices remain responsible for grants; PCT is not a worldwide grant procedure.
Apply two acceptance checks in the workspace
Choosing a field and jurisdiction in Patent Task selects the relevant workflow, not a legal conclusion. Use the field-specific preparation guide for technical material and the international workflow guide for handover and local review.
Which should be addressed first?
Resolve gaps that change the understanding of the invention while checking jurisdictional issues that affect strategy. Review the final files afterward. Formatting cannot turn unresolved core facts into a completed application.
