Korean Patent Amendment Preparation: Original Basis and Issue Records
Start a Korean amendment or response with the actual notice and original application. Identify the affected claims, technical issues and cited documents before selecting an amendment, argument or procedural route.
Turn the notice into an issue record
| Field | Information to preserve |
|---|---|
| Location | Notice passage and affected claims |
| Basis | Applicable provision, cited document and relevant passage |
| Current wording | Original text and technical meaning |
| Proposed handling | Reason for an amendment or explanation |
| Original support | Location in the original description, claims or drawings |
The official Korean procedure overview describes notices, written opinions and amendments and links amendment scope to the original disclosure. Available actions still depend on the procedural stage and applicable rules.
Distinguish clarification from new information
In a synthetic example, the application describes one connection and the client later proposes a different, undisclosed structure. Better performance does not make that structure an originally disclosed alternative. Mark it as new information for the responsible practitioner to assess.
Also record how changes to dependencies, numbers, terms or signs affect the rest of the text. A short edit can still change scope.
Avoid procedural shortcuts
Priority examination, PPH, division and separation procedures have particular conditions. None should be described as a universally available answer to a refusal. Prepare questions about eligibility, deadlines, documents and consequences instead of promising timing or success rates.
Compare language versions
Retain the original, Korean translation and proposed revision and identify the text actually filed. Older KIPO English overviews and current MOIP materials may have different revision histories. Verify current Korean provisions and the actual notice for a procedural decision.
This article explains review practice for Korean matters. Patent Task does not currently start KR drafts; its drafting workspace supports US, EP and JP targets. For a Korean matter, check any AI-generated issue summary or response candidate against the original documents and the applicable Korean requirements.
When is a response candidate usable?
Confirm that it addresses the notice, relies on real references, preserves technical facts and identifies amendment basis. It must not make unapproved procedural decisions for the responsible practitioner. See Korean document preparation and team handover.
